Terms of Service

IN GENERAL, I WILL DRAW THE FOLLOWING:
- Human/human-like characters
- Simple backgrounds
- Your OCs
- Fandom characters
- Real people
- Mildly spicy content (kisses, suggestive poses/clothing, bare chests)IN GENERAL, I WILL NOT DRAW THE FOLLOWING:
- Explicit sexual content (I'm not very good at it)
- Explicit violence or gore (see above point)
- Animals or anthro characters (khajiit, argonaians, tabaxi, etc.) (again, not very good at it)
- Hateful or bigoted content
- Anything that makes me uncomfortableIN GENERAL, THE FOLLOWING ELEMENTS WILL INCUR ADDITIONAL CHARGES:
- Highly complex armor/outfits
- Highly complex props or set pieces
- Additional outfits
- Detailed backgrounds/foregrounds/framing



By purchasing my services, you agree to the following. If you have a problem with any of these terms, they may be changed if discussed with me prior to paying for your commissioned piece.


1. GENERAL TERMS- The exact final style of a piece is up to my creative whims and may not be perfectly represented by the given examples.- Prices are subject to change based on demand.- I have the right to reject any order that I do not feel comfortable drawing for any reason.- You DO NOT have the right to feed ANY of my art to any AI, ever.


2. PAYMENT- Currency accepted is USD and can be paid through PayPal. PLEASE NOTE THAT THE PAYPAL ACCOUNT WILL BE UNDER A DIFFERENT NAME (Genevieve Wayne).- Commissions are preferably paid in advance, but if that does not work for you, I can take half upfront and the other half after delivery of the final illustration.- Don't send me any payment before I have agreed to take on your commission and have requested that you send me the payment.


3. PROCESS AND DELIVERY- The time it takes to finish your commission varies depending on factors such as my health, the complexity of the commissioned piece, and my other work.- If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.- Once the piece is finished, I will send you a high resolution PNG, and I can send additional files in smaller resolutions if so desired.


4. REVISIONS- I will offer you 1 chance to revise anything when I complete the linework of your piece, and you may also request color/shading edits on the final piece.- ONCE I START PUTTING DOWN COLORS OR SHADING, YOU MAY NO LONGER REQUEST MAJOR LINEART CHANGES. Be sure you are happy with the lineart before giving me the go-ahead to color or shade it!


5. COPYRIGHT / USAGE POLICYI, Jay Wayne (the artist), claim the rights to the produced image file, not the buyer. Therefore I am allowed to use the copyrighted materials to:- Promote myself with it everywhere- Display it everywhere to my liking (website, social media, etc.)- Post it wherever I want


The buyer is allowed to:- Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)- Print the piece and claim the ideas as their own, but not the art itself.- Use the piece to promote themselves. You are not forced to give me credit when you post it but it is very appreciated.- Use the piece on their website, social media, or Youtube channel as long as the piece itself is not generating profits (ie being sold or provided as part of a subscription).


The following is considered copyright infringement:- Reproducing/using the copyrighted art commercially - means making money off it in any way.- Claiming the art as your own- Altering the content of the image file without my consent- Using the art for the purpose of training, priming, or prompting any AII reserve the full rights to the image file and its use/distribution unless otherwise agreed upon.


6. CUSTOMER SATISFACTION- I will do everything I can to make my customers happy, within reason!- If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.- I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your piece anywhere, we can discuss this.


7. REFUND / CANCELLATION POLICY- The buyer is not allowed a refund once I started working on the commission.- If for any reason I am unable to start your commission you will receive a full refund.- If you cancel your order before I start it, you can get a full refund.If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the art commissioned by me, Jay Wayne (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying for your commissioned piece.


8. WHAT DO YOU GET?- Watermarked lineart before I put down color or shading- A clean, signed image document in the resolution(s) of your choice- When applicable, a rough palette showcase
